OFFICIAL RULES AND REGULATIONS

September 21, 2009 - November 22, 2009

This contest is presented by CTV Television Inc. ("CTV") and Nintendo of Canada, Ltd. ("Nintendo") (CTV and Nintendo are collectively referred to as the "Contest Sponsors").

  1. TO ENTER the Wii Get Up and Play Challenge contest (the "Contest") entrants simply need to visit the web site located at www.wiigetupandplaychallenge.com and www.wigetupandplaychallnege.ca (collectively, the "Contest Site"), and create a profile featuring their family (a "Family Profile") by following the instructions found on the site. In the event of a dispute, entries received on-line shall be deemed to be submitted by the "Authorized Account Holder" of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entrants who are under the age of majority will be required to provide their parent/guardian contact information at the time of entry in the Contest and the Contest Sponsors will confirm the parent/guardian's consent to participate in the Contest. A Family Profile must include the entrant's first and last name, address, email address, age, ten digit day time telephone number, password and a title for the Family Profile. Creation of a Family Profile containing the foregoing information will provide the entrant with one (1) entry into the Contest. Limit of one (1) Family Profile per household throughout the Contest Period. If it is discovered that multiple Family Profiles were created for a single household, all entries for such household will be void. Contest starts at 10:00:00 a.m. Eastern Time ("ET") on Monday, September 21, 2009 and closes on Sunday, November 22, 2009 at 11:59:59 p.m. ET (the "Contest Period"). There is one (1) grand prize (the "Grand Prize") to be won from among all the eligible entries received/earned during the Contest Period. There are nine (9) Weekly Prizes to be won from all eligible entries received/earned during any week of the Contest Period as described below (the "Weekly Prizes"), (collectively the "Prizes" and each a "Prize") No purchase necessary. Void where prohibited. Limit of one Weekly Prize per household for the entire Contest Period.

  2. SUBMISSION OF ENTRIES:

    All content submitted by entrants may be posted by the Contest Sponsors, and by their agents and representatives, to public viewing galleries and may also be used on other Contest Sponsor-owned websites to promote the Contest and disclose the Contest's outcome.

    In addition to receiving one (1) entry upon creation of a Family Profile, an entrant will receive the following number of additional entries for the Contest for making the following submissions on the Contest Site:

    7 Photo with entrant's best family pose. Acceptable photo formats; jpeg, gif, tiff, bmp MAX file size – 10 MB. Once per day
    5 Entrant sharing a Wii family experience (Text Based), MAX 250 words Once per day
    3 Entrant sharing Wii tip(s) or game strategies (Text Based), MAX 250 words Once per day
    1 Why the entrant's family wants to win the Ultimate Grand Prize (in essay form, max 250 words) Once only

    Please note that an entrant's "Family" depicted in such entrant's Family Profile may or may not include individuals other than such entrant. In the event that third parties are in fact included, such entrant must ensure that he or she has obtained consent from all such third parties, and in the event that the third parties are minors, that such entrant has obtained consent of the minor's parent or legal guardian.

  3. SUBMISSION GUIDELINES:

    Any entrant whose submission involves anything illegal, potentially or actually dangerous or harmful or containing any element of physical risk, will be disqualified from the Contest. Submissions must not include any illegal, defamatory or in any way obscene or inappropriate content. Any submission that involves a third party that has not agreed to be part of the submission may be disqualified at Contest Sponsor's discretion. Entrants must also ensure their submissions are original and do not include any third party's proprietary content (other than that relating to the Nintendo Wii), including trade-marks or copyrighted content. Contest Sponsors, in their sole discretion, may disqualify any entrant who uses third party proprietary content (other than that relating to the Nintendo Wii). Contest Sponsors reserve the right, in their sole discretion, to edit any entry submission to blur out any trade-marks or to remove any copyrighted content, including but not limited to, music or third party video clips.

    Additional entries for the Contest will also be awarded for the following:

    Popular Vote:

    The public is free to visit the Contest Site, view Family Profiles and cast votes for the Family Profiles that they like and dislike. Public voting will take place from Monday, September 21, 2009 at 10:00:00 a.m. through to Sunday, November 22, 2009 at 11:59:59 pm. ET. An Entrant will receive one (1) additional entry for each unique thumbs up or thumbs down vote that his or her Family Profile receives from visitors to the Contest Site during that day up to a limit of ten (10) additional entries per day. There is no limit to the number of times any person can vote during each day, however a person cannot vote more than once per computer, per day for the same Family Profile. If it is discovered that attempts were made to vote for a Family Profile more than once in any single day from a same computer, , then all votes cast during such day that are associated with that computer will be void. Use of any automated, script, macro or robotic program by an entrant to submit votes for such entrant's Family Profile may result in the disqualification, in the sole discretion of the Contest Sponsors, of such entrant.

  4. To enter and to be eligible to win, an entrant must be a legal resident of Canada (excluding Quebec) and be thirteen (13) years of age or older. This contest is not open to residents of Quebec. Employees and their parents, siblings and children, and persons domiciled with an employee of any of the Contest Sponsors, their respective agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter. An entrant who is under the age of majority in the province in which he or she resides at the date of entry is eligible to enter the Contest and win a Prize provided that the parent or legal guardian of such entrant accepts any such prize and the terms and conditions hereof for and on behalf of such entrant.

  5. Grand Prize - There is one (1) Grand Prize consisting of a trip for four (4) to Whistler, British Columbia. Trip includes: (a) roundtrip economy airfare for four (4) from a major airport closest to the Prize winner's place of residence in Canada (hereinafter referred to as the "Departure Point"); (b) five (5) nights accommodation (based on two (2) rooms, double occupancy) as chosen by the Contest Sponsors; (c) four (4) Whistler Blackcomb four day lift tickets; (d) two (2) adult and two (2) youth or child four day Hi Performance Ski or Snowboard rentals; (e) one (1) family full day private ski or snowboard lesson for 4 people; (f) four (4) tickets to Coca-Cola Tube Park; and (g) return ground transportation to Whistler from Vancouver International Airport. Prize winner and his/her travelling companions are solely responsible for all costs not expressly described herein including, without limitation, applicable taxes, fuel/currency surcharges, ground transportation, meals and beverages, room service, gratuities, merchandise, telephone calls, insurance together with any required travel documentation, and all personal expenses of any kind or nature, together with any applicable overnight layover. Departure dates and accommodation are subject to availability and change without notice or compensation. Prize winner and his/her travelling companions are also solely responsible for all costs incurred to and from the Departure Point as the Prize originates and terminates there. It is the sole responsibility of the Prize winner and his/her travelling companions to obtain all necessary travel documentation including passports and visas, as applicable. In addition, the Grand Prize winner may, at the discretion of the Contest Sponsors, be required - as a condition of being awarded the Grand Prize - to allow a Canada AM camera crew and personality into his or her residence to film a segment for Canada AM in which the Grand Prize winner will appear and compete in a Wii Challenge (note: Wii Challenge is for fun only and no additional prizing will be awarded).

  6. Weekly Prizes - There are nine (9) Weekly Prizes each consisting of one (1) of one (1) Wii prize pack (prize pack to include Wii Sports Resort game, Wii Music game, NHL2k10 game, Wii Motion Plus accessory, Wii branded Backpack, Wii Sport Resort branded lei, Wii Brochure, Wii Frisbee). Approximate retail value of each Weekly Prize is Two Hundred Dollars ($200.00) Cdn.

  7. Acceptance of Prizes. Prizes must be accepted as awarded. The Prizes may not be sold, exchanged or transferred, and are not convertible to cash. Contest Sponsors reserve the right to substitute a Prize in whole or in part in the event that all or any component of the Prize is unavailable. Prize winners are solely responsible for all costs not expressly described herein. Proof of identification must be provided upon request. In order to be declared a winner, potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by CTV. Unclaimed Prizes will be forfeited.

  8. Determination of Grand Prize Winner. On or about Thursday, November 26, 2009 at approximately 9:00 a.m. ET, a random draw for the Grand Prize will take place at CTV's offices in Toronto, Ontario from among all eligible entries received during the Contest Period. The first entry drawn will be eligible to win the Grand Prize. The odds of winning a Grand Prize will depend upon the total number of eligible entries received during the Contest Period. Grand Prize winner is not eligible to win any Weekly Prize.

  9. Grand Prize winner and his/her travelling companions must be able to travel at the times and dates as determined by the Contest Sponsors in their sole discretion and authority, failing which the Prize will be forfeited. It is recommended that Grand Prize winner and his/her travelling companions obtain sufficient personal insurance prior to departure. In the event the Grand Prize winner is under the age of majority, he or she must be accompanied by his or her parent or legal guardian at all times while participating in all components of the Grand Prize. Blackout periods are from: December 19, 2009 – January 10, 2010, January 25, 2010 – March 21, 2010 and April 2, 2010 – April 5, 2010. Travel must be completed by Sunday June 6th, 2010 Trip is also subject to Whistler Blackcomb operating dates. No change in travel arrangements can be made by the Grand Prize winner once the booking has been confirmed. The Grand Prize may not be used towards any type of frequent flyer mileage, or other reward point accumulation program. Approximate retail value of the Prize is Seven Thousand Two Hundred and Seventy-Five Dollars ($7,275.00) Cdn. based on Toronto departure. In the event Prize winner resides within a 300 km radius of Whistler, British Columbia, the Prize is deemed not to include airfare and no cash will be provided in lieu thereof.

  10. Determination of Weekly Prize Winner. Random draws for Weekly Prizes will take place each Thursday starting on October 8, 2009 and concluding on November 26, 2009 at CTV Television Inc., Toronto, Ontario from all eligible entries received from Monday at 12:0:01 a.m. ET to Sunday at 11:59:59 p.m. ET the week prior to the draw (for example, the draw on October 8, 2009 will be from entries received from Monday, September 21 to Sunday September 27, 2009). For entries that require parental consent, if such consent is received by Wednesday at 11:59:59 p.m. ET immediately before the Thursday draw, then that entrant will be entered in the weekly draw conducted on the Thursday. If such consent comes after that cut-off, then the entrant will be entered into the next weekly draw. For the last weekly draw, the entrant must be confirmed by Wednesday November 25, 2009 at 11.59:59 p.m. ET to be included in the Weekly Draw or the Grand Prize draw. The first entry drawn will be eligible to win a Weekly Prize. A Weekly Prize winner is no longer eligible to win additional Weekly Prizes. The odds of winning a Weekly Prize will depend upon the number of eligible entries received by week as outlined above. CTV, acting reasonably, will attempt to contact potential winner or, if under the age of majority, his or her parent or legal guardian, by telephone within two (2) business days after the draw. In the event the potential winner cannot be contacted within 2 business days after the draw, he or she will be disqualified and an alternate potential winner will be drawn.

  11. Before being awarded a Prize, potential winner or, if under the age of majority, his or her parent or legal guardian, and, with respect to a potential Grand Prize winner, his or her traveling companions, or, if under the age of majority, such traveling companions' parent or legal guardian, will be required to sign and return within the time stipulated by the Contest Sponsors, a full release and indemnity form stating that he/she: (i) has read and understood these official rules and regulations ("Rules"); (ii) grants all consents required; (iii) authorizes the Contest Sponsors to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity relating to the Contest, and/or for general news, entertainment and information purposes relating to the outcome of the Contest, at no additional compensation to the potential winner, beyond the awarding of or participation in the Prize; (iv) accepts the Prize as offered; and (v) releases the Contest Sponsors and Whistler Blackcomb from any and all liability of any kind arising out of the potential winner's and his/her traveling companion(s)' (as applicable), participation in this Contest and receipt and use of the Prizes.

  12. In the event that the potential winner and/or, in the case of a potential Grand Prize winner, his/her traveling companion(s), does/do not comply with any requirements set forth in these Rules, Contest Sponsors shall have the right to disqualify potential winner and/or his/her traveling companion(s)' (as applicable), and select an alternate potential winner and/or traveling companion(s) and the Contest Sponsors shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner and/or traveling companion(s), if applicable, shall be applied, with the necessary amendments, until a qualified winner and/or travelling companion(s) have been duly selected.

  13. All decisions of the Contest Sponsors with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest.

  14. By entering this Contest an entrant, or if under the age of majority, his or her parent or legal guardian: (i) represents that his/her entry submission is his or her original work and does not infringe on any third party's copyright, trade-mark or other intellectual property rights, (ii) that he/she has all necessary rights from any third party that appears, or is mentioned, in any submission, including those from the parent or legal guardian if third party is under the age of majority; (iii) grants the Contest Sponsors, an unlimited, royalty free, irrevocable, perpetual, worldwide right and license to reproduce, post and/or broadcast the submission in any form of media now known or hereinafter developed, including, without limitation, on websites owned by the Contest Sponsors, for the purposes of this Contest as well as for advertising and promotional purposes relating to this Contest; (iv) waives all moral rights throughout the world in the submission in favour of the Contest Sponsors, (v) agrees to release, indemnify, discharge and hold harmless the Contest Sponsors and Whistler Blackcomb, their respective parent, subsidiary and affiliated companies, and their respective officers, directors, employees, agents and representatives from any claim or liability arising from or related to the submission, participation in this Contest, and/or acceptance and or use of any Prize awarded, and (vi) consents to the publication and/or use, in any medium of the entrant's entry, name, city of residence, photograph and/or image for publicity purposes carried out by the Contest Sponsors or their advertising and promotional agencies in conjunction with the Contest without payment or compensation of any kind.

  15. Entry Submissions will be showcased by Contest Sponsors on a public viewing gallery.

  16. Contest Sponsors assume no responsibility for any claims against infringement of the right of privacy or personality rights with respect to any Submission submitted.

  17. All entries become property of Contest Sponsors who assume no responsibility for garbled, lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting names of prize winners (for which a self-addressed, postage paid envelope must be included). Contest Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed, misdirected, altered or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials-data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsors, in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Contest Sponsors reserve the right to cancel, terminate, modify, amend, extend or suspend the Contest including cancelling any method of entry, and select a winner from previously received eligible entries. Contest Sponsors reserve the right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsors reserve the right in their sole discretion to disqualify any entrant they find to be tampering with the entry process or the operation of the Contest, or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest Site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsors reserve their right to exercise any available remedy and seek damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including, but not limited to, any injuries to an entrant or damage to an entrant's computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable. Contest Sponsors shall not be held responsible for any misuse of any information provided on, accessible through and/or discernable from an entrant's Family Page and/or any submission.

  18. Contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this Contest, each entrant consents to the collection, use and distribution of his or her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsors for the purposes of implementing, administering and fulfilling this Contest, including, without limitation, publishing the contest winner's names and disclose to the public that they have won a prize with respect to the Contest. Personal information of the Grand Prize winner may also be used and disclosed in conjunction with the production, advertising and airing of the Canada A.M. television segment discussed in paragraph 5 of these Rules. Entrants may "opt-in" to receive commercial messages from CTV or Nintendo unrelated to the Contest. Any inquiry concerning the personal information held by the Contest Sponsors should be addressed to CTV Television Inc. at 299 Queen Street West, Toronto, ON, M5V 2Z5.

  19. In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.

  20. All intellectual property in any contest related materials and/or intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations, are owned by the Contest Sponsors and/or their parents, subsidiaries, or affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
